Delhi riots accused Tahir Hussain on Thursday filed his nomination papers from the Mustafabad constituency after he was granted custody parole by the Delhi High Court and he returned to Tihar Jail right after.

The former Aam Aadmi Party (AAP) councillor is the candidate of Asaduddin Owaisi-led All India Majlis-e-Ittehadul Muslimeen (AIMIM) from Mustafabad for the February 5 assembly polls. Hussain is contesting against Bharatiya Janata Party's sitting Karawal Nagar MLA Mohan Singh Bisht and AAP's Adil Ahmad Khan who have been fielded from Mustafabad for the upcoming elections.

By giving a ticket to Hussain, the AIMIM has marked its debut in the February 5 elections in the city. The party has planned to contest 10-12 seats in areas with significant Muslim populations, such as Chandni Chowk, Badarpur, Okhla, and Seelampur.

Hussain filed his nomination and returned to custody at 2:16 PM after leaving Tihar Jail earlier in the day to complete the process, a source said.

Ji-Hyun Yan scored the only South Korean goal that came in the 30th minute of the clash. 

"He was released from jail under heavy security provided by Delhi Police. He left the jail around 9:15 AM," the source added.

The party may announce its other candidates later in the day.

Speaking to PTI, AIMIM's Delhi president Shoaib Jamai said, "We will not contest all seats but, wherever we do, we will leave no stone unturned. Our candidates will be strong, like Tahir Hussain from Mustafabad and Shafa-ur-Rehman from Okhla. Both are currently jailed in cases related to the CAA-NRC protests."

The Delhi High Court had on Tuesday granted custody parole to Hussain in a riots-related murder case to enable him to file his nomination papers.

Charges Against Tahir Hussian And What Delhi HC Has Said So Far

Hussain had appealed for interim bail from January 14 till February 9 for poll campaigning and staying out of jail till the Delhi Assembly election results are declared on February 8. But Justice Neena Bansal Krishna refused his plea for interim bail, saying that the gravity of allegations against Hussain, that he was the main perpetrator in the violence which resulted in the death of several persons, could not be overlooked.

The Delhi High Court while granting custody parole to Hussain to file his nomination, stated, that as many as 11 FIRs were registered against him in connection with the riots and he was admittedly in custody in a related money laundering case and UAPA case.

Hussain's senior counsel had argued that fighting elections was a complicated process, which required him to not only file his nomination by January 17 but also open a bank account and campaign.

Maintaining that contesting elections was not a fundamental right, the police had alleged that Hussain who was the "main conspirator" and "funder" of the February 2020bet88 riots could complete formalities and fight polls on custody parole.

Hussain, in his regular bail plea had said that he spent 4.9 years in jail and though the trial started in the case, only 20 of the 114 prosecution witnesses were examined so far.

Pleading that he had suffered a long incarceration, he said the fact that several witnesses were still left to be examined meant the trial wouldn't be over soon.

The co-accused, his plea said, allegedly involved in the riotous mob and committing the offence of murder were granted bail by the high court.

Hussain is charged in multiple cases that also include the murder of Intelligence Bureau (IB) staffer Ankit Sharma during the communal violence in February in 2020 in northeast Delhi.

Violence broke out in northeast Delhi on February 24, 2020, leaving 53 dead and several injured.
